We have a strong commitment to providing excellent service to all of our customers and visitors of this website and other perenso.com sites, including respecting your concerns about privacy. We understand that you may have questions about how we collect and use personal information. We have prepared this statement to inform you of the privacy principles that govern the use of our perenso.com websites and the services that we provide (Statement).
This Statement applies to any access to our websites or any use of our services or any software application (Application) that we make available to you (Services). By accessing our website and/or by using our Services or an Application, you consent to the terms of this Statement.
This website is an Australian website (as are the other Perenso websites) and we are based in Australia. Accordingly, we are governed by the laws applicable in Australia. The laws applicable in Australia may be different from those in your country and you should consider this before using this website and any of our services.
When we refer to ‘personal information’ in this Statement we mean information or an opinion, whether true or not, and whether recorded in a material form or not, about an identified individual, or an individual who is reasonably identifiable.
2. Overview
Broadly speaking we collect personal information in the following contexts:
2.1 when you are browsing our perenso.com websites (Browsing Information); and
2.2 when you request us to provide you with a service or as part of providing you that service (Service Information).
In addition, when you are inputting or transmitting data (Your Materials) into or through an Application we provide, Your Materials are stored in third-party databases as described below.
We have set out below the information you need to consider for each of these activities.
3. Browsing Information
3.1 Information We Collect
Other than as described below, we do not collect personal information from you when you are browsing our websites. This means that, unless you voluntarily and knowingly provide us with personal information, we will not know your name, your e-mail address, or any other personal information about you.
When you request a page from our website, our servers log the information provided in the HTTP request header including the IP number, the time of the request, the URL of your request, and other information that is provided in the HTTP header. We collect the HTTP request header information in order to make our website function correctly and provide you the functionality that you see on the website, as our servers use this information to deliver to you the pages on the website. We also use this information to better understand how visitors use our website and how we can better tune our website, its contents, and functionality to meet your needs.
3.2 Cookies
Our websites use “cookie” technology. “Cookies” are encrypted strings of text that a website stores on a user’s computer.
We, and the service providers we use to serve and host our web content, and/or deliver our e-mails, use session, and persistent cookies, to track the number of times the relevant website is accessed and whether the site was accessed from an advertisement or another linked site. Sometimes cookie technology is used to track the number of times a page is viewed. We use cookies to identify which pages are being used and, if you provide your personal details to us, to tailor the provision of our services to you. This also helps us analyse data about web page traffic and improve our website in order to tailor it and our services to customer needs.
The cookie generated from the advertisement or e-mail does not itself contain any personal information and will remain on your hard drive until you delete it.

4. Service Information
4.1 Information We Collect
When we need to collect personal information from you to provide you with a particular service we will ask you to supply us with the information we need. For example, if you would like us to send you a white paper (if available) or you request access to the exclusive video section, we will ask you for information such as name, address, telephone number and email address. We will use your email address to send a confirmation and, if necessary, use the other information to contact you if we need help processing your request. We will also use your email address to notify you about special offers and promotions as described in the E-Mail section of this Statement, but you can opt out of e-mails at any time.
4.2 Securing the Transmission and Storage of Information
We treat the Service Information you provide to us as confidential information; it is, accordingly, subject to the Company’s corporate policies regarding the protection and use of confidential information.
After Service Information reaches the Company it is used by the Company in Australia for the provision of services to you and stored on a secure server that resides behind firewalls designed to block unauthorised access from outside of the Company. Service Information we collect is currently processed and stored on our behalf by Microsoft® in the United States and in Singapore (and in other locations if required for the provision of the Microsoft services) largely as described in sections 5.1 and 5.2 below. We may in the future decide to store your information in another country or with another provider. If we do so we will update this Statement.
Privacy laws in the jurisdictions used by Microsoft may differ from those applicable in Australia and in your country, and Microsoft’s terms of use and privacy policy may differ from ours. We cannot ensure that Microsoft will comply with privacy laws similar to those that apply in Australia and your country, and accordingly, the Service Information may not receive the same protections as it would in Australia or your country.
By using an Application, you consent to our use of the Service Information in Australia for the provision of services to you (and otherwise as described in this Statement) and the Service Information is transmitted to and stored on the Microsoft servers hosted in the United States and in Singapore (and in other locations if required for the provision of the services) in accordance with this Statement, even though it may not receive the same protections that it would in your country.
If you do not want the Service Information to be transferred to us and our servers overseas, you should not use the Application.
4.3 Your payment information
If you choose to pay for our Services by credit card or any other form of payment, your credit card and payment details are used and retained by the Company or provided to our third-party payment gateway providers solely for the purpose of processing payments from you.
To the extent that we provide deferred payment terms, we generally do not collect other credit information or if we do we do not communicate it to credit reporting agencies.
4.4 Disclosure of Information to Third Parties
We provide your Service Information to service providers to the extent necessary to provide you with the Services (for example, when goods are required to be shipped, freight companies, clearing houses, etc would receive your address and contact name information) and for the administration of the services and our subscription agreement with you.
Otherwise, all other personal information, preferences, interests, etc, included in the Service Information remain confidential to the Company.
4.5 E-Mails about Special Offers and Promotions and Opt-Out
It is our intention to only send you e-mail communications that will be useful to you and that you want to receive. When you provide your e-mail address, we will periodically contact you via e-mail and provide information about special offers and promotions that may be of interest to you, and you consent to us doing so. If you do not wish to receive e-mails with updates and information, there is an UNSUBSCRIBE option on each eNewsletter. In addition, every time you receive an e-mail you will be provided the choice to opt out of future e-mails by following the instructions.
Any opt-out will not stop emails we are required to send you for the purpose of providing you the services we have agreed to provide or administration of those services but these service emails will not include marketing material.
In any event, we do not sell, rent, or trade lists of personal information regarding our users or subscribers to third parties for marketing purposes.
5. Your Materials loaded into the Perenso Application
5.1 Your Materials
The Applications we provide allow you to store and access Your Materials that you load into or through the Application. Your Materials are routed through our servers to our third-party database provider and received, processed, and stored by that third-party database provider.
Currently, our third-party database provider is Microsoft® using the Microsoft Azure® program. Details about how Microsoft treats Your Materials that you load into or through an Application and Microsoft’s privacy policy are available at http://azure.microsoft.com/en-us/support/legal/. From time to time we may change our third-party database provider and if so we will update this Statement at that time.
You are solely responsible for Your Materials and if Your Materials include personal information about you and/or others:
(a) you warrant to the Company that you are authorised to collect, hold, use, and disclose that information and that the Company is authorised to collect, hold, use, and disclose that information for the purposes of providing you with the applicable Services; and
(b) you agree to comply with all applicable privacy laws in relation to that information.
This means that you must take all necessary steps to ensure the individual concerned is aware of and/or consents to the various matters detailed in this Statement, to the extent required by applicable laws, and otherwise comply with applicable privacy laws in connection with Your Materials.
5.2 Transmission and Storage of Your Materials
All Your Materials, including personal information, that is inputted into or transmitted through the Application by you or at your direction, are routed through the Company’s servers to our third-party database provider (Microsoft) by transmission across the Internet.
Currently, Microsoft stores Your Materials on servers located in the United States and in Singapore (and in other locations if required for the provision of the services) on the terms applicable to the Microsoft Azure product available at the link provided above.
The Company cannot give an assurance that Your Materials will be secure at all times when stored by Microsoft and the Company is not responsible and accepts no liability for any unauthorised access to your data or loss of your data by Microsoft or anyone else or any failure of Microsoft security or any wrongful use of your personal information by Microsoft or by anyone else.
Further, the Internet is not in itself a secure environment and we cannot give an assurance that Your Materials will be secure during transmission. Transmission of Your Materials over the Internet and storage of Your Materials as described in this Statement is at your risk and you should only use an Application to store Your Materials if you accept these risks.
By using the Application, you consent to Your Materials including any personal information being stored and transmitted in accordance with this Statement.
5.3 Transfer overseas
As stated above, currently Your Materials are stored by Microsoft on servers located in the United States and in Singapore (and in other locations if required for the provision of the services) on the terms applicable to the Microsoft Azure product available at the link provided above.
Privacy laws in these jurisdictions may differ from those applicable in Australia and in your country, and Microsoft’s terms of use and privacy policy may differ from ours. By using an Application, you consent to Your Materials being transmitted to and stored on the Microsoft servers hosted in the United States and in Singapore (and in other locations if required for the provision of the services) in accordance with this Statement, even though it may not receive the same protections that it would in your country.
If you do not want Your Materials to be transferred to our servers overseas, you should not use the Application.
If the location of Your Materials changes in the future, we will update this Statement. You should review our Statement on this website regularly to keep informed of any updates.
5.4 Use of Your Materials and Disclosure to Third Parties
We do not use Your Materials for any purpose other than providing you with the applicable Services the subject of our subscription agreement (including for a free trial) which includes the use of the Application to access and retrieve that information. Your use of that information is a matter for you but must comply with all applicable laws including privacy laws.
Accordingly, we will not disclose Your Materials, except as stated above and as requested by you. We will also disclose Your Materials if required by law, including as required by law enforcement agencies, courts, and government and regulatory bodies.
6. Other Sites
The Company is only responsible for the privacy statement and content of the Company’s websites including perenso.com We are not responsible for the privacy practices or the use of cookies on websites that you have accessed our websites from or any website that you may access from our websites.
7. Legal Issues
7.1 This is an Australian website and is subject to Australian law. The Company will disclose personal information without your permission when required by law. As mentioned above, laws related to personal information vary by country.
7.2 The Company is a small business operator and as such the Privacy Act 1988 (an Act of the Commonwealth of Australia) and the Australian Privacy Principles do not generally apply to the Company.

If you use the Application or our services or enter into an agreement with us, after the date of any such change to this Statement, you will accept and you will be deemed to have accepted any such amended Statement.
